Fasttrack to Diamond Executive

Let's see, Joe Land got booted resigned from Quixtar December 31, 2004. Before leaving Quixtar, Land had reached the Diamond level and ran his own "tool business" called Alliance Net Solutions (now called ProSystemOne and owned by Joe Pici). Due to Quixtar's "Non-Compete and Anti-Raiding Rules" (Rule 6.5 et. al) one would assume that Land left Quixtar for Oasis Life Sciences with nothing and would be forced to build his new MLM from scratch, just like everyone else. Of course, such an assumption would be wrong, not to mention naive.

According to the Oasis Life Sciences Event Schedule (updated March 5, 2005) Joe Land has already reached "Diamond Executive" status and was one of three "Hosts" for a "Regional Conference" in Tampa on March 19 (Google Cache & Screen Shot)

So, let's see if I got this right. While Joe Land was a Quixtar Diamond running his own "tool business" he was building a competing MLM business called Oasis Life Sciences. He built that business for a few months (I discovered it in November, 2004 but he was probably building it before then) and a little more than three months after getting canned resigning from Quixtar he's a Diamond Executive "Host" at one of the competing MLM's Conferences. Name one Amway or Quixtar Diamond that reached that coveted level so quickly. Go ahead, name one. Can't do it can you?

Also, did you notice the other host on that list? None other than Marshall Douglas. You remember him don't you? Sure you do. He's another former Quixtar Diamond. Was in a little group called Team in Focus.

Here's my question: Will Quixtar enforce its own rules and shut down Joe Land for violating those rules? Survey says! Not likely. Why not? Because Joe Land isn't Bo Short.

What does last para means? They kicked him out right? How else they can shut down Joe Land? You mean his Alliance company? How about other ppl in Alliance who did not violate the rule?

If Joe Land left Quixtar and took any of his downline with him then he's probably violated the Non-Compete, Anti-Raiding rule and Quixtar could (at least according to their rules) pursue him legally. Sue him.

They could also investigate and boot out all of Land's downline that is working both Quixtar and Oasis right now.

Joe land is most likely promoting Oasis and whatever in a low-key "anti-Quixtar" way. Bo Short jumped out and effectively said " I left Quixtar cause x.y.z.... join Passport instead, it what MLM should be." He created the competition, although some argue that Passport is not a "competitor" to Quixtar.

IF Joe Land merely joined an existing MLM, it is different. If he is not doing the "Quixtar-bash" (except maybe as a speaker at functions saying he left from "another MLM"), then he is low on the Quixtar radar.

As for shutting him down, they already yanked his Quixtar/Amway downline from him. If they go after any IBOs who went with him, they can take their downline as well...but how can they do anything about his Oasis business?

As soon as he was resigned... Quixtar took his downline. Fine, so if some of the downline join him in Oasis, they know Quixtar will kick them out too. But are those people even considering themselves active? Could they have basically "Quit Quixtar" and be IBOs only in the fact that their membership hasn't expired yet? We don't know.

My opinion has always been, once I quit (or get booted out) your rules no longer apply to me. How can you enforce what I do after I no longer belong to you? Arbitration? How come you can't take it to court as a FORMER IBO?

They could sue him for damages caused by all those who quit to join him in Oasis. The Non-Compete rules apply to IBOs after they quit or are terminated - so he's still under that obligation.

Moreover, that dispute would go to arbitration if Quixtar so chose to take it there. And Joe Land would not only lose, but he would be socked with Quixtar's attorneys' fees and legal costs as well.

They could crush him if they wanted to. The Arbitration Agreement allows them to pretty much do as they please.
